Opponents of the Affordable Care Act (ACA) have brought various lawsuits claiming that Congress lacked authority to pass the ACA but it is well-settled that the Commerce Clause of the Constitution allows Congress to make laws addressing national economic problems. The ACA addresses a national breakdown in the health insurance market that has resulted in widespread denials of coverage, limited access to health care, and increased health care costs. By addressing the economic impacts of the discrimination that women face in the health insurance market, it also falls within a long tradition of civil rights laws falling well within Congress’s authority under the Commerce Clause.

This nationwide annual analysis by the National Women's Law Center compares child care assistance policies from year to year and to and 2001 in four policy areas: income eligibility, waiting lists for assistance, copayment requirements and reimbursement rates for providers. Some states have made progress, but most states continue to be behind where they were in 2001.

One year ago in Wal-Mart Stores, Inc. v. Dukes, a deeply divided Supreme Court in a narrow 5-4 decision limited workers’ ability to come together as a group to challenge discrimination by large employers. It dealt a particular blow to women in low-wage jobs, who make up a disproportionate share of the low-wage workforce. For this group of workers, the challenges of living on low wages are too often compounded by persistent workplace discrimination.  This fact sheet discusses the Equal Employmente Opportunity Restoration Act of 2012 and how it will affect low-wage women workers.

The National Women's Law Center filed an amicus brief in the case Ollier v. Sweetwater in the 9th Circuit.  The case involves several questions of importance in the continuing effort to ensure that women and girls are treated equally in athletics.  In our brief, we focus on the validity and practicality of OCR’s three-part test, as well as the need to allow class retaliation suits, especially given the coach/team relationship.

The National Women’s Law Center filed an amicus brief in the Eighth Circuit in a case involving the contours of a school’s responsibility under Title IX to respond to harassment that occurs off-campus between two of its students.  The trial court had decided that because the college student was sexually assaulted at a privately-owned apartment building the school had no responsibility to investigate and respond to the assault once the student survivor reported it.
